After years of Dem control of the Watauga BOE, Dems are now apoplectic over the fact that they are no longer in control and - SURPRISE! - Republicans have different ideas of how things should be run than Dems do. As someone once said
- "Elections have consequences".
One of the changes made by the current BOE was to
relocate the Boone 2 polling place from the Student Union to Legends. Legends, as almost everyone knows, is right off of 321, is on campus and is about as geographically central to the precinct as it is possible
to get. Dems are so upset over this change that they are practically running in circles, tearing their hair out and flooding local on line blogs with comments whining over the unfairness of it all. We
even have reports of one Dem, a former BOE member herself, running down King Street screaming
obscenities into her cell phone and disturbing the squirrels, birds and other residents of the area who are trying to prepare for the upcoming winter.

This is apparently based on some twisted misunderstanding of the old "fairness doctrine" which isn't any longer in effect and wouldn't apply in any case. Eggers has pointed out that he, in fact, CHARGES for his advice (a fact which I can personally confirm) and that since he charges the county by the hour for any legal work he does for them, the county doesn't want him responding to legal questions from every employee, committee member, board member or citizen sentenced to county employment as part of a community service plea agreement. This seems to me to be a sensible.position for the county to take. It appears that even if Mr Eggers is giving FREE advice to relatives, that doesn't entitle the rest of us to the same benefit.
Now the county could, of course, direct Mr Eggers to provide legal opinions to any county employee or board member that might ask. Perhaps Commissioner Kennedy could bring that up at the next BOC meeting?
At any rate, it appears that unless things change, Mr Eggers will probably continue to converse and assist family members without charge while Ms Campbell and the rest of us will have to pay for our own legal advice.
This had upset the Dems very much! Since they apparently don't have any practical recourse, they have taken to claiming that Mr. Eggers is somehow acting illegally or -at least - unethically. It seems that in Dem La-La Land, EVERYONE must always be treated equally and that includes people who are not part of the Eggers family (A fine family of civic minded people by the way - who have, for several generations now, given freely of themselves and their time in order to serve this community!)
We aren't lawyers ourselves, and can't give LEGAL advice - but, we can pass on to frenzied mob of local Dems, the opinion of UNC Professor of public law and government at UNC-CH Christopher McLaughlin, as quoted in a recent article in ASU's "The Appalachian":
There is no formal conflict of interest regarding Four Eggers helping Luke Eggers with resolutions, said Christopher McLaughlin, assistant professor of public law and government at UNC-Chapel Hill.......
Professor Mclaughlin went on to say: " based on what I've read about this situation it seems that a reasonable person could conclude that the county attorney can still competently represent the county despite his informal involvement with the county board of elections."
Reasonable person? Maybe....Watauga Democrats? You judge for yourself.
